To understand the Enagic compensation plan, imagine you are in a large shopping mall and you have the opportunity to open booths there.

Each booth represents a line in your organization.

The more booths you open:

How do you open a booth?
Every time a distributor makes a direct sale, they open a new booth.

How to Capture All 8 Points

Enagic allows a distributor to open 6 POSITIONS AS A DISTRIBUTOR, IN THEIR OWN NAME.

These positions must be placed under them, within their own organization.

You can thus create multiple new lines under your main position, and therefore capture all 8 points โ€” if placed correctly.

โžก While simply being able to earn the 8 points is already very motivating in itselfโ€ฆ

The real wealth is built by thinking toward the future: using these positions strategically to move up in rank and become 6A2 as quickly as possible. And at the same time, having those below you who are actively working toward 6A do the same.

The Enroller and Sponsor must be the same person.

No. SP protection goes only to the Enroller. The direct Sponsor must therefore ensure they are active before the sale is processed if they wish to maintain their own SP status.

Can an existing distributor who purchases a Ukon use this program?

No. If an existing distributor purchases a Ukon themselves, they are considered to have "enrolled" themselves. SP protection then goes to the direct Sponsor ID.

Can the sale be placed outside your 8 points?

Yes โ€” for SP protection, the Enroller can place the sale outside their 8 points, as long as the Sponsor is within their own group. However, for 6A2 and 6A2-2 incentives, the sale must be within the 8 points.

SP Protection = SP Commissions?

Yes. As soon as a sale is made and the Enroller is named, they recover their SP status for 3 months and therefore receive their full commission: SP bonus + base commission.

How to Fill Out the Application Form?

Every form must have the Enroller section filled out. If the Enroller and Sponsor are the same person: fill out the Enroller section and check "Same as Above" for Sponsor. Unable to Purchase the Machine in Full

The Tokurei program is reserved for those who are unable to purchase the machine in full by cash or credit card. It is a solution to start the business regardless.

Make at Least One Direct Sale โ€” Submitted at the Same Time

The applicant agrees to sell and submit at least one Product Order Form & Distributor Agreement for purchase by cash, credit card, or finance โ€” NOT through another Special Payment Plan. This sale must be submitted at the same time as the applicant's Tokurei application.

โš ๏ธ While the Special Payment Plan is in effect, sales of Ukon products will not apply towards any offset and will not count towards group total sales.

Mary then receives her machine and earns her official Kangen Distributor title with all the benefits that come with it:

Important Rules to Know

โฌ†๏ธ Upgrade Possible, No Downgrade

The Tokurei distributor can choose a higher machine than the one initially selected. However, it is not possible to choose a less expensive machine once the program has begun.

The SP (Special Point) bonus does not apply to the distributor for the entire duration of the Tokurei program. They will only regain their SP once the machine is fully paid off.

Qualification for the Title Achievement Bonus

The qualification threshold is 10 points, not simply 10 sales. Some products do not count for a full point:

Preamble โ€” Who Enagic USA Is and How Distribution Works

Enagic USA, Inc. (Torrance, CA) markets wellness products, primarily water ionizing and filtration devices. Distribution is based on Direct Selling โ€” one-on-one presentations and consultations with customers. Distributors do not purchase inventory for resale; they place orders for the end customer directly with Enagic.

The system operates as a multi-level direct sales organization: the Compensation Plan defines the distributor's missions, the criteria to advance in rank, and the commissions paid in return.

The Independent Distributor Agreement is governed by the laws of the State of California, USA. You may conduct business in any US state or other country where Enagic is officially open (list available upon request from Enagic USA).

Admission, Activities & Independent Contractor Status

2.1 โ€” Admission

To become an Enagic distributor, you must be of legal age (18 or older, or the age of majority in your state), be sponsored by an existing distributor, and have your Independent Distributor Agreement accepted by Enagic USA management. Enagic reserves the right to decline an application without stating a reason. Only one person per household may sign an Agreement. There is no purchase required to become a distributor. You are notified of your admission through the delivery of your Distributor ID number.

2.2 โ€” Your Two Activities
  • Selling: You present and sell Enagic products to end customers. All products are ordered directly from Enagic โ€” no modification, no re-packaging, no re-bottling. Selling Kangen water in bottles (or under any other label) is strictly prohibited, even for free.
  • Sponsoring: You recruit new distributors and train them. It is strictly prohibited to make income claims or earnings projections during recruitment, or to imply guaranteed results. Any false, misleading, or exaggerated statement is prohibited.

Your Agreement with Enagic does not create an employer/employee relationship. You are a self-employed independent contractor (1099). 2.4 โ€” Tax & Reporting Requirements

Before commissions can be paid, you must submit a completed IRS Form W-9 to Enagic USA. Without a valid W-9 on file, commission checks may be withheld.

Enagic issues an annual Form 1099-NEC (or 1099-MISC) for total commissions paid, in accordance with IRS reporting thresholds. You are responsible for reporting all income on your personal or business tax return and for paying estimated quarterly taxes if required.

Carrying personal general liability insurance for your business activities is strongly recommended.

2.5 โ€” Consumer Conduct & FDA Rules

You must comply with all applicable federal, state, and local consumer protection laws, including the FTC Direct Selling and Business Opportunity rules.   • Maintain a personal social media presence (Facebook, Instagram, YouTube, TikTok, etc.) about your Enagic business โ€” as long as you follow the rules below.
  • Create a personal website only with prior written authorization from Enagic USA, and in compliance with their branding guidelines โ€” your domain and email may not contain the word "ENAGIC" or "KANGEN."
  • Notify Enagic in advance of any public promotional event (location, date, content).
What Is Prohibited โœ—
  • Selling Enagic products on any third-party online marketplace โ€” Amazon, eBay, Craigslist, Facebook Marketplace, etsy, etc. Online sales are not Direct Sales and are not eligible for commissions.
  • Making statements about Enagic products, the compensation plan, or potential income that are not consistent with official Enagic materials.
  • Making medical, health, disease, or therapeutic claims of any kind.
  • Making income, lifestyle, or earnings claims (e.g. "make $10,000 a month," screenshots of paychecks, luxury lifestyle implications tied to Enagic income).
  • Using any sales or recruiting tool not approved by Enagic (print, digital, video, etc.).
  • Sending unsolicited bulk emails, SMS, or faxes (spam) โ€” you must comply with the CAN-SPAM Act and TCPA.
  • Commenting publicly in the media about Enagic without Enagic's prior written consent.
  • Creating a website or landing page that mimics or could be confused with official Enagic websites.
๐Ÿ“Œ Any violation of these rules may result in immediate sanctions, including suspension of commissions and termination of your Distributorship.

Non-Competition & Confidentiality

  • You may sell other products or services that do not compete with Enagic โ€” only if you do so separately, never during the same presentation or conversation as an Enagic pitch. You must inform Enagic in writing of any secondary business activity.
  • It is prohibited to offer, suggest, or encourage a member of your Enagic organization to sell other products (even non-competing ones) in place of or alongside their Enagic activity.
  • No compensation, kickback, or payment may be paid directly between distributors. No cross-purchasing of products for resale either.
  • During the term of the Agreement and for two (2) years after termination, you must maintain the confidentiality of all non-public information concerning Enagic, its members, its products, and its sales system โ€” including downline data and genealogy reports, whether inside or outside your direct line of responsibility.

Income & Compensation

Your commissions are calculated under the Enagic 8-Point Compensation Plan, based on the direct sales generated within your line of responsibility. You must promptly review all commission statements and report any discrepancy to Enagic without delay.

If a customer returns a product within their legal rescission window (typically three business days under the FTC Cooling-Off Rule, or longer where state law provides), Enagic will debit your account for any commissions already paid on that sale.

Commission checks and direct deposits are issued on Enagic's standard payment schedule. A minimum payment threshold may apply โ€” balances below the threshold roll forward until met.

Enagic makes no income guarantees. Your earnings depend entirely on your own effort, sales activity, and skill. Most distributors should expect modest supplemental income, not full-time replacement income.

Customer Cancellations & Returns

Under the FTC Cooling-Off Rule, a customer who purchases goods of $25 or more at a location other than the seller's permanent place of business has the right to cancel the sale within three (3) business days. Some states provide longer rescission windows โ€” the longer period applies where required by state law. As a distributor, you must respect this right and clearly inform every customer of it at the time of sale, in writing.

If a customer cancels within the legal window and returns the product in its original condition and packaging, you process the return through Enagic and the customer is refunded. Commissions already paid to you on that sale will be debited back from your account.

Returns that do not comply with the Cooling-Off Rule or Enagic's return policy are not obligated to be accepted.

Term & Termination

  • The Independent Distributor Agreement is an at-will agreement of indefinite duration. No renewal fees apply.
  • Either party may terminate the Agreement at any time with written notice. Enagic customarily requires a thirty (30) day notice period, though immediate termination may be elected in cases of breach.
  • On the termination date, you must cease all activity in the name of Enagic. Commissions on orders transmitted up to the termination date will be paid.
  • The Agreement may be terminated immediately, without notice, for serious breach โ€” including but not limited to: making medical or income claims, online sales on third-party platforms, violating direct-selling rules, making false statements to prospects, or any other violation of the Policies & Procedures.
  • No compensation, severance, or indemnity is owed to either party upon termination.
  • After termination, you must observe a six (6) month waiting period before re-enrolling as an Enagic distributor under a different sponsor.

Force Majeure

Neither party shall be held liable for failure to perform its obligations when that failure is caused by an event beyond its reasonable control โ€” including but not limited to natural disasters, pandemics, acts of government, power or internet outages, shipping disruptions, or supply-chain failures affecting Enagic USA.

The affected party must notify the other in writing as soon as practicable. If the disruption continues for more than thirty (30) days, either party may terminate the affected portion of the Agreement without penalty.

Transfers, Death, Spouses & Changing Sponsor

9.1 โ€” Transfer of Distributorship

A distributorship is personal and cannot be sold, assigned, or transferred to a third party without the prior written consent of Enagic USA. Enagic USA may approve a transfer when the proposed successor is qualified, commits to the Policies & Procedures, and agrees to complete any required training.

9.2 โ€” Death of a Distributor

Upon the death of a distributor, the distributorship may be inherited or transferred to a legal heir in accordance with applicable law and Enagic USA's written procedures. The heir must submit the required documents (death certificate, proof of heirship, W-9) and be approved by Enagic USA before any commissions can be reassigned.

9.3 โ€” Married Couples & Household Members

A married couple (or members of the same household) is treated as a single distributorship. Spouses and household members may not hold positions in different lines of sponsorship. In the event of divorce, Enagic USA may, at its sole discretion, reassign the position to one spouse upon presentation of a divorce decree or court order.

9.4 โ€” Changing Sponsor (Line of Sponsorship)

Changing your line of sponsorship is not permitted as a general rule. Two narrow exceptions may apply: (a) where the original sponsor has engaged in clearly unethical enrollment practices (Enagic USA decides at its sole discretion), or (b) after a full, voluntary termination of the distributorship followed by the mandatory six-month waiting period.

Product Warranty

Enagic USA stands behind the quality of its products. Most Kangen Waterยฎ ionizers sold in the United States carry a 5-year limited manufacturer's warranty on parts and labor (specific coverage varies by model โ€” always refer to the current warranty card included with the unit and the official Enagic USA documentation).

If an end-customer reports a defective product, the distributor must direct the customer to Enagic USA customer service (or submit a return/exchange request through the standard Enagic USA process). A return authorization number is required before any unit may be shipped back for warranty service.

Limitation on Claims & Dispute Resolution

Any claim arising under or related to the Agreement โ€” including warranty claims, compensation disputes, or any other contractual matter โ€” must be submitted to Enagic USA in writing within one (1) year of the date you knew or should have known of the underlying facts, unless a longer period is required by applicable law.

The parties will first attempt to resolve any dispute through good-faith discussion. If that fails, disputes are subject to the dispute-resolution terms set out in the Enagic USA Policies & Procedures (which may include mandatory mediation and/or binding arbitration under California law).

Data Privacy & Consumer Protection

As a distributor, you handle personal information belonging to your customers and prospects (names, addresses, emails, phone numbers, purchase history). You are responsible for handling that information lawfully and respectfully. You agree to:

  • Use personal information only in connection with your legitimate Enagic USA distributor activity.
  • Never sell, rent, or trade customer or prospect lists.
  • Comply with all applicable U.S. privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) where it applies to your business, and any other state privacy laws that cover your customers.
  • Honor customer rights of access, correction, and deletion of their personal data upon reasonable request.
  • Take reasonable security measures to protect the data you hold (secure storage, strong passwords, no unencrypted shared spreadsheets, etc.).
  • Notify Enagic USA promptly of any suspected data breach affecting Enagic customer or distributor data.
  • Upon termination of the Agreement, stop using and securely delete or return any Enagic-related personal data you hold.
๐Ÿ“Œ Email and text messaging are additionally governed by the CAN-SPAM Act and the TCPA (see Article 3). Never add prospects to marketing lists without their consent, and always provide a clear opt-out.

Changes to Rules & Applicable Law

Enagic USA may, from time to time, update its Policies & Procedures, Compensation Plan, product pricing, and distributor forms to reflect legal, regulatory, or business needs. Changes will be communicated through the usual channels (email, distributor back-office, official website, or other written notice).

Continued participation as a distributor after the effective date of a change constitutes your acceptance of the updated terms. If you disagree with a change, your remedy is to terminate your distributorship in accordance with Article 7.

This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, subject to any mandatory arbitration clause set out in the Policies & Procedures.

Incorporated Documents & Final Provisions

This Agreement, together with the Enagic USA Policies & Procedures, the Compensation Plan (8-Point Plan), the Distributor Application, and any current product warranty terms, constitutes a single integrated agreement. All of these documents are incorporated into this Agreement by reference and form an indivisible whole.

Severability. If any provision of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions will remain in full force and effect, and the parties will cooperate in good faith to replace the invalid provision with an enforceable term that reflects the original intent as closely as possible.

Entire Agreement. No verbal representations, side agreements, or unwritten understandings exist outside of the documents listed above. Only written amendments issued by Enagic USA are binding.
